Traffic Tickets Are Never Automatically Removed
Video Transcribed: Can you get traffic tickets expunged in Oklahoma? I’m Oklahoma expungement attorney James Wirth and that’s the question that’s asked of me today is can traffic tickets be expunged? And the answer is yes and no and it depends on what your goals are and what you’re trying to do.
Many traffic offenses have the possibility of jail time, they are considered misdemeanors so they do fall within title 22, section 18. Just like a criminal expungement, you can expunge those court records. If you’re arrested related to a traffic citation, same thing.
It’s on your OSBI background check, it’s eligible for expungement under section 18. So you can get your court records cleaned, you can get your OSBI records cleaned for traffic tickets by doing your typical expungement, just like any other criminal case because technically it’s probably a misdemeanor traffic offense.
However, does that clean it off your driving record with the department of public safety in Oklahoma? It does not. It will clean it up on your records that are publicly available there, but for your driving record available through the Department of Public Safety, it will not remove it.
But there you primarily need to be concerned with points, there are some things that you can do to reduce the number of points that are on your driving record, such as do a defensive driving course that can remove two points.
Also, unlike a criminal offense or a traffic ticket misdemeanor felony, when you have a public record on those, they’re never automatically removed. So that ticket, that conviction, whatever it is, will stay on there forever unless you file for the expungement.
It’s different for your driving record, those automatically fall off after a period of time, a maximum of five years that they’re on there. So, hopefully, that answers your question.
