Child Support Stops Once the Child either Graduates, Drops Out, or Turns 20 Years of Age
Video Transcribed: Until what age must I pay child support in Oklahoma? I’m Oklahoma Lawyer James Wirth. We’re doing a series related to Oklahoma child support. And the question is, how long do you have to pay child support? This one is statutory as well.
You can find it under Oklahoma law. It’s Title 43, Section 112, Subsection E. And what it provides is that “Any child shall be entitled to support by their parents until the reaches 18 years of age.”
But then it’s got a, however, although it doesn’t say, however, it says, “If a child is regularly enrolled in and attending high school or other means of high school education or alternative high school programs as a full-time student, the child shall be entitled to support by the parents until the child graduates from high school or until the child turn 20 years of age, whichever occurs first.”
And then it notes that “No hearing or further orders required to extend child support pursuant or beyond 18 years of age.” It just happens automatically and stops once the child either graduates drop out or turns 20 years of age.
So how long do you have to pay child support for any individual child? It’s until the child turns 18 if graduated. If not graduated, until the child graduates, drops out, or turns 20 years of age. If there are multiple kids involved, it can be more complicated because they will not automatically modify or change the amount of support when the older child ages out.
As long as there is a younger child that is still under that order, they’ll keep it as the same out. It’s up to you to file for that modification. All right.
