Protect Your Rights with a Special Appearance
What is a special entry of appearance in Oklahoma courts? I’m Tulsa Lawyer James Wirth, that’s the question that we have. So anytime you’re making a first appearance in a case, meaning that you’re entering a case, you file an entry of appearance. It’s a formal document that lets the court know that you’re getting in either as a party pro se or as an attorney representing a specific party and you’re providing your address of record on that document so that everybody in the case knows how to give you formal notice of any pleadings being filed. So that’s an entry of appearance.
But what is a special entry of appearance? Well, the thing about a regular general entry of appearance is the courts have found that if you enter an appearance like that, you’re waiving certain things, particularly waiving jurisdiction, personal jurisdiction and venue. And by filing that general entry of appearance, you’re waiving that. So in some circumstances, you may want to file something in the case to contest those things and you certainly don’t want to waive them.
When to Use a Special Entry of Appearance
So that’s where we have a special entry of appearance where you’re entering just for a limited purpose and it states what purpose you’re entering in. You’re not entering for any other purposes and you’re trying to avoid waiving things such as jurisdiction. So that’s what a special entry of appearance is, is when you’re only getting in for a specific purpose and you’re wanting to be careful so as not to waive certain defenses or certain jurisdictional issues.
If you’re dealing with a case that you may need to file a special entry of appearance, you probably want to talk to an attorney about that. These legal issues can be complicated. You’re going to want legal advice specific to your circumstances.
