Mediation in Custody Battle
Are you in the middle of a custody battle and you’re wondering if mediation can help? My name is Carl Birkhead. I’m an attorney with Wirth Law Office in Tulsa, Oklahoma. I’ve been practicing family law for about seven years and I want to help you make law easy by just describing a little bit about what mediation is and discussing the benefits that it might have for you.
I love mediation. I think that it’s always a good idea to try to resolve these cases yourself instead of going to court, throwing it against the wall, and letting the judge decide for you. I prefer to be the one that’s in control and have at least one hand on the steering wheel in trying to get these cases settled instead of just praying that we have a strong enough case that the judge agrees with us.
Benefits of Mediation
I typically try to take my cases to mediation. It doesn’t always work, but there are so many benefits. The biggest one is financial. It’s going to be a lot cheaper to go to mediation for a couple of hours than it will be to go have a full-blown trial and all the prep work that goes into that, the days, weeks, and months leading up to trial.
I always explain it this way. You have two options in front of you. You can pay me $10,000 because that’s probably what it’s going to take to take this thing to trial for the weeks, days, and months leading up to it, the prep work, vetting witnesses, collecting evidence, making multiple copies, getting to trial, spending a full day in trial. Easily, that’s going to be $10,000 on your bill.
