Essential Tips for Navigating a Traffic Stop
Let’s talk about traffic stops and what you should do if you find yourself in the middle of one. Hi, I’m Tulsa criminal attorney Carl Birkhead with Wirth Law Office in Tulsa, Oklahoma. I’ve been practicing family and criminal law for over seven and a half years, and I want to help you make law easy by talking to you about what to do if you find yourself at a traffic stop.
Staying Calm During a Traffic Stop
Getting pulled over is never a good feeling. You see those red and blue lights in your mirror, and your heart starts racing. It’s okay to be frustrated or nervous — just don’t panic. Stay calm.
Police can stop you for all sorts of reasons — a broken taillight, failing to signal, speeding, or even something as small as an air freshener blocking your view. Whatever the reason, you’re in a tricky spot. You’re not under arrest, but you’re also not free to leave.
Your Rights and Responsibilities
The key here? Watch what you say. Be polite, even if the officer isn’t. Keep your license and insurance ready — if it’s digital, have it pulled up on your phone. And remember, officers don’t have to read you your Miranda Rights unless you’re in custody, but anything you say can still be used against you.
You have the right to remain silent. If an officer starts questioning you, calmly say, “I’m exercising my Fifth Amendment right to remain silent.” They won’t like it, but they can’t force you to talk.
Handling Searches and Aftermath
As for searches — don’t consent. Even if you think you have nothing to hide, don’t do their job for them. Say, “I do not consent to a search.” But know that refusing may lead to a longer stop if they decide to call in a drug dog for probable cause.
Bottom line: Be respectful, be smart, and know your rights. If you’ve had a traffic stop and think something wasn’t handled correctly, give us a call — we can help.
