And today we are going to begin a series of videos where we break down the four essential parts of any successful negligence claim. And today we’re going to be discussing part one, which is duty.
Now for any successful negligence claim, you first have to show that one party had a reasonable standard of care that they had to maintain towards another party. Now throughout this series, we will be using an example of a car wreck.
So for our car wreck, any time a person gets into a vehicle and gets out on the roadways, they are accepting the responsibility and they are going to operate the vehicle in a safe manner and pay attention to the roads and conditions around them. That is what establishes that duty to those who they might come into contact with, be they pedestrians, other vehicles, or anything like that.
