And today we’re going to be continuing our discussion on the elements that make up a successful negligence claim. Now, to recap, the four hours elements are a duty, a breach of duty, causation, and damages. In today’s video, we’re going to be focusing on the aspect of causation.
Now, in order to have a successful negligence claim, you have to have a duty that was established, the breaching of said duty, and then you also have to show that the injuries that a person received were the result of the actions of that duty being breached.
So for example, say to use our ongoing theme of a car wreck, you have to show that the injuries of a person have been a direct result of that car wreck. So they can’t just happen to have injuries and say, “Oh, well, I’m injured. Thus, I need to be compensated.” They have to be able to show that the injuries they received were from that car wreck, or even if they had pre-existing conditions, that said condition was exacerbated because of that car wreck.
