From Petition to Trial.
A paternity action is typically initiated when parties have a child outside of marriage. This process involves filing a petition for paternity and temporary orders, followed by serving the other party with these documents. The other party has 20 days to respond before a default judgment may be entered.
The Parenting Plan Conference
After the initial filing, the court sets a Parenting Plan Conference where parties are encouraged to reach a temporary custody and visitation agreement. The court may make adjustments at a final trial if necessary. During the PPC, the court provides important information on required parenting courses and videos.
The Discovery Process and Mediation
If paternity is contested, parties may undergo DNA testing. The Discovery Process allows for information exchange through interrogatories, document requests, and requests for admissions. Following discovery, parties must attempt mediation to reach agreements on custody and support.
