Unconventional but Effective: The Nesting Agreement Explained
What is nesting in an Oklahoma custody case? I’m Tulsa attorney James Wirth and that is the question that we have. It has to do with the type of visitation or custody schedule. But it’s an unusual one, you don’t see it very often. Most of the time, at least from my experience, I don’t think I’ve ever seen it ordered by a court without the agreement of the parties.
So normally, in a typical case where you’ve got a custody schedule, visitation schedule in place, the kids are moving back and forth between the two parents’ households. So the kids will be here one week and then there one week. And go back and forth like that, or maybe a two, two, three schedule. So two days there, two days there, weekend there. Two days there, two days there, weekend here. Those are typical schedules.
Understanding Nesting Agreements
But when we’re talking about a nesting plan for visitation or a nesting agreement, what that means is that it’s not the kids moving back and forth, it’s actually the parents moving back and forth. So you’ve got your main home, maybe it’s the marital home if we’re talking about a divorce, and the kids have been residing there and now the parties are separated.
We don’t wanna disrupt the kids, so we’re gonna have the kids continue to reside there, but the parents don’t get along and they don’t wanna live together. So rather than one of the parents moving out, the parents alternate going back and forth. So it’s the parents that are maybe, it’s mom’s there for a week, then dad’s there for a week, then mom’s there for a week, or two, two, three schedule there as well, where it’s mom for two, dad for two, mom for the weekend, dad for two, mom for two, dad for the weekend.
Considerations for Nesting Agreements
That’s what a nesting agreement is. It’s where the kids remain in the nest and the parents alternate in and out. And it can be great for kids and great for the parents as well if the parents are getting along well and they agree to it. It’s not a great plan if there’s gonna be a lot of combat and fighting between the parents, but it is a good one under the right circumstances.
