Starting November of 2024, a new law in Oklahoma grants individuals the right to a temporary order hearing in a custody and visitation case within 30 days, or 10 days if domestic violence or abuse is alleged. This law addresses delays in obtaining temporary order hearings, particularly in Tulsa County and Oklahoma County District Court.
Under Title 43 section 110, parties filing for temporary orders in cases such as divorce, legal separation, or paternity will have their initial hearing set within 30 days. If allegations of domestic violence or abuse are present, the hearing must be scheduled within 10 days.
