Understanding Deferred Sentences
When people come to our office facing criminal charges, their main concern is simple: “I don’t want to go to jail.” That’s a reasonable goal, and the good news is that there are multiple ways to avoid incarceration—without spending tens of thousands on a jury trial.
One option is a deferred sentence. This means you plead guilty or no contest, but the court delays a formal conviction while you complete probation, which typically lasts 18 months to two years. If you meet all requirements—such as fines, classes, or counseling—you can withdraw your plea, have the case dismissed, and even expunge it from your record.
The Role of Suspended Sentences
A suspended sentence is similar, but with one key difference: you are convicted immediately. Instead of serving jail time, you remain on probation for the length of your sentence. As long as you follow the conditions—whether it’s check-ins, drug tests, or fines—you avoid jail.
If neither option is available and a trial isn’t in your plans, there’s also the blind plea. This means you bypass negotiations and ask the judge for leniency. It’s unpredictable, but in many cases, it results in a better outcome than you might expect.
