Essential Steps for Introducing Evidence in Court
How do we introduce evidence in court? I’m Tulsa criminal lawyer Carl Birkhead with Wirth Law Office in Tulsa, Oklahoma. I’ve been practicing family and criminal law for about seven years now and I want to help you make law easy by talking about how to introduce evidence and use it during your trial.
The Role of Your Attorney
In most cases, your attorney will handle the bulk of the work during the evidence introduction. This phase is where you can relax a bit and let your lawyer lay the groundwork to introduce exhibits into evidence. However, you still have a role to play.
For example, if you provided screenshots that are relevant to your case, your attorney may ask you to confirm what you’ve handed over, ensuring the material hasn’t been altered. You’ll simply confirm that the screenshots are in their original form. Afterward, your attorney will present the exhibit to the court.
Your Involvement in Evidence Presentation
While your attorney will guide you through this, you don’t need to read every detail of the exhibit into the record. Typically, we’ll only need you to confirm the authenticity of the exhibit. In rare cases, such as when opposing counsel objects, your attorney may ask you to read parts of it.
This phase of litigation can be an enjoyable one for attorneys, as we get to use the evidence to strengthen our case strategically. You’ll work alongside us to ensure the exhibits serve your interests. We may even share a laugh during the process, especially when it helps us make a strong impact on the case.
Ensuring Evidence Relevance and Preparedness
If you have any questions about the upcoming trial and how your evidence is going to come into play, or whether or not your evidence is going to be relevant or helpful, or useful, call us. I’m more than happy to sit down with you. We will go over what you’ve got, and we will make sure that we are fully prepared for court.
