Understanding Custody Agreements
Do you have a custody and visitation agreement that’s just not working out? I’m Tulsa family law attorney Carl Birkhead with Wirth Law Office in Oklahoma. I’ve been practicing family and criminal law for about seven years now, and I want to help you make law easy by talking just a little bit about when a visitation schedule just doesn’t work anymore.
I see this happen a lot around breaks from school, especially when the schedule you have doesn’t work in all instances. Let’s say the schedule was fine right after you got the custody order in place, whether it’s through a paternity case or a divorce, but now it doesn’t. You have a new significant other who has kids of their own that you want to try to work into what’s going on, or you have more biological children of your own that you’re trying to figure out how to make sure that they get to spend as much time with their sibling as possible over spring break, for example.
Considering Custody Modifications
Let’s just say you’re in a situation where you have a custody order with your kids, but now you’re married and your spouse has a custody order with their kids, and they just don’t line up. These are times when you need to consider filing for a custody visitation modification. Honestly, these are things that can be done without too much conflict. Nobody wants to go to court over visitation issues if they can be avoided.
So it could just be a simple matter of you get an attorney, your attorney talks to the other side’s attorney, you guys negotiate, sit down with a calendar and negotiate what works out, what makes sense, and then you write it up and make it a court order. It doesn’t have to be a long, drawn-out process, but you need to make sure that it’s something that you feel is worth doing, because anytime you’re going to be filing something with the court, you start to roll the dice about what changes there might be.
Ensuring a Harmonious Family Life
It’s worthwhile to try to make sure that you have something workable between not just yourself and your former partner, but your current partner and their co-parent as well. You want to make sure that things are as smooth, harmonious, and peaceful for the kids as possible. So make sure that you’ve got a court order that will work.
