A lot of people assume that the moment handcuffs go on, officers are required to read you your Miranda rights. That’s not always the case. The process can vary depending on the county. Some departments have Miranda rights printed on a card they read from, others might have you sign something later at the station. So, just because you haven’t been read your rights yet doesn’t necessarily mean you’re not under arrest.
When Are You Officially Under Arrest?
Generally, when you’re officially being arrested, the officer will say something like, “You’re under arrest for XYZ,” and that’s often when the handcuffs go on. But sometimes, handcuffs are used before an arrest — maybe to keep you calm, prevent harm, or control the situation. In those cases, being cuffed doesn’t automatically mean you’re under arrest or that officers are required to Mirandize you at that moment.
That said, don’t assume you’re in the clear just because your rights haven’t been read. Whether you’re technically under arrest or just being detained, anything you say can still be used against you. Officers don’t have to advise you of your rights until they begin a custodial interrogation — that’s the key point.
